What Shiftnimbo does

Shiftnimbo is software that helps companies post shifts, find and manage workers, and record hours, and helps workers find shifts and track their work. Unless we agree otherwise in writing, Shiftnimbo is not your employer or the employer of anyone you hire: the company offering a shift is responsible for the employment relationship, including pay, taxes, workplace safety and legal compliance at its sites.

Your account

• You must be at least 16 and legally allowed to work, or to hire, where you use Shiftnimbo.
• Give accurate information, and keep it up to date — especially credentials and documents.
• Keep your password secure. You are responsible for activity on your account.
• If you create a company account, you confirm you are authorised to act for that company, and you are responsible for the people you invite to it.

Using Shiftnimbo fairly

You agree not to:

• post false, misleading, discriminatory or unlawful shifts, profiles or documents;
• falsify clock-ins, location or hours, or clock in for someone else;
• harass, threaten or spam other users;
• use other users’ information for anything other than the shift it was shared for;
• interfere with, reverse engineer, scrape, or try to get unauthorised access to Shiftnimbo or its data.

We may remove content or suspend or close accounts that break these terms or put other users at risk.

Shifts, hours and pay

Companies set shift details and pay rates and are responsible for paying workers for the hours worked. Shiftnimbo records clock-ins and timesheets to help both sides agree on hours; every correction is logged. If you disagree with your hours, raise it with the company first, and contact us if you need help.

Fees

Shiftnimbo is free for workers. Companies pay the fees on the pricing page or in their agreement with us. We will give notice before changing fees that apply to you.

Your content

You keep ownership of what you upload. You give us permission to store, process and display it only as needed to run Shiftnimbo and as described in our privacy policy.

Ending your account

You can stop using Shiftnimbo and delete your account at any time. We may suspend or end access if you break these terms or if we stop offering Shiftnimbo, with notice where reasonable.

Disclaimers and liability

Shiftnimbo is provided “as is”. We work to keep it accurate and available but can’t promise it will be uninterrupted or error-free, and we don’t guarantee any company or worker, or that a shift will be filled. To the extent the law allows, Shiftnimbo is not liable for indirect or consequential losses, and our total liability to you is limited to the greater of the fees you paid us in the 12 months before the claim or US$100. Nothing in these terms limits rights you have that the law doesn’t allow us to limit.

App stores

If you downloaded the app from the Apple App Store or Google Play, these terms are between you and Shiftnimbo, not Apple or Google, who are not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

We may update these terms and will post changes here with a new date; for significant changes we will tell you in advance.
